These Terms & Conditions (“Terms”) govern your access to and use of the Talent Tube website and mobile apps (collectively, the “Platform”) operated by Talent Tube (“we,” “us,” or “our”). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility & Accounts

  • You must be at least 16 years old to use the Platform.
  • You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials.
  • We may require identity verification (e.g., KYC) for booking payouts or posting jobs.

2. Platform Roles & Services

Talent Tube is a marketplace where:

  • Individuals (“Creators/Providers”) upload short video reels, create service packages, and accept bookings.
  • Users (“Clients”) browse reels, book services, and pay via Stripe-powered escrow.
  • Companies (“Employers”) post jobs and receive applications.

We are not a party to agreements between users, nor an employer or recruiter. We provide the technology and escrow workflow only.

3. Payments, Stripe Escrow & Fees

  • Payments are processed by Stripe. Card data is handled by Stripe; we do not store full card numbers.
  • When a Client books a Provider, funds are placed into escrow. Funds are released to the Provider upon Client confirmation of delivery or automatically after 7 days from scheduled delivery if no dispute is opened (timelines may vary by service and region).
  • Platform, processing, or payout fees may apply and will be shown at checkout or in your dashboard.
  • You authorize Stripe to process payments, hold funds, and make payouts in accordance with Stripe’s terms and applicable laws.

4. Cancellations, Refunds & Disputes

  • Prior to release, Clients may request cancellation/refund via the order page. Providers may accept, or propose a revised delivery.
  • If there is a dispute, funds remain in escrow while we review the submitted evidence. We may (but are not required to) mediate and make a final decision to release or refund based on Platform policies and proof of delivery.
  • Chargebacks initiated with the card issuer may override Platform decisions. You agree to cooperate in the chargeback process and provide accurate evidence.

5. Job Postings & Applications

  • Employers must post accurate jobs and comply with applicable employment and labor laws.
  • We are not responsible for hiring decisions, employment relationships, or workplace disputes.
  • Applicants are responsible for verifying job details and the Employer’s legitimacy before sharing sensitive information.

6. User Content & License

You retain ownership of reels, packages, profiles, and other content you upload (“User Content”). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, distribute, and display User Content on the Platform as necessary to operate and promote the Platform (including via our social channels and emails). You represent and warrant you have all rights needed to grant this license.

You may not upload content that is illegal, infringing, fraudulent, pornographic, hateful, harassing, or otherwise violates these Terms or our policies. We may remove or restrict content at our discretion.

7. Prohibited Conduct

  • Misuse of escrow, fee avoidance, or payment outside the Platform.
  • Impersonation, scams, or posting misleading jobs or packages.
  • Infringing, obscene, or unlawful content or activities.
  • Reverse engineering, scraping, or interfering with the Platform.

8. Ratings & Reviews

Reviews must be honest and based on real experiences. We may remove reviews that are spam, abusive, or unrelated to the transaction.

9. Intellectual Property; DMCA

The Platform, including our logos, UI, and code, is owned by us or our licensors. Except as allowed by these Terms, you may not copy, modify, or distribute the Platform.

If you believe content infringes your copyright, contact talentube@mlxsoft.com with a takedown request containing sufficient detail (a DMCA-style notice). We may remove content and/or terminate repeat infringers.

10. Third-Party Services

The Platform integrates third-party services (e.g., Stripe, hosting/CDN, analytics). Their terms and privacy practices govern your use of those services. We are not responsible for third-party acts or omissions.

11. Taxes

Providers are responsible for reporting and paying any taxes arising from payouts received via the Platform. Employers are responsible for taxes related to their job postings and hires.

12. Suspension & Termination

We may suspend, limit, or terminate accounts and remove content for any violation of these Terms or suspected fraud or abuse. You may close your account at any time; certain obligations (e.g., fees owed, dispute cooperation) survive termination.

13. Disclaimers; Limitation of Liability

  • THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN FEES IN THE 6 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

14. Dispute Resolution & Governing Law

These Terms are governed by the laws of [Insert Jurisdiction] without regard to its conflict of laws rules. Any dispute between you and us shall be resolved in the courts or arbitration forum of [Insert Venue]. You agree to the exclusive jurisdiction and venue of those courts. Where arbitration is mandated by law or agreed by the parties, disputes will be resolved by binding arbitration on an individual basis (no class actions). Nothing here limits consumer rights that cannot be waived by law.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with the “Last Updated” date above. Material changes may be communicated via email or in-app notice. Continued use after changes means you accept the updated Terms.
